These terms apply to the use of DTIA Bridge. They describe what the service is, what you may and may not expect from it, and the arrangements around accounts, subscriptions, intellectual property and liability.
1.Definitions
- DTIA Bridge: the web tool that guides a user through a Data Transfer Impact Assessment and produces a dossier.
- Provider: Recht & Robots, which offers DTIA Bridge.
- User: the organisation or person using DTIA Bridge.
- Account: the personal access to DTIA Bridge.
- Dossier: the DTIA assessment generated by the tool.
- Subscription: the paid service with which dossiers are monitored and kept current.
- Review/bespoke: the provider's separate legal service, distinct from the tool.
2.Applicability
These terms apply to every use of DTIA Bridge. By creating an account or using the tool, you accept these terms. Deviations apply only if agreed in writing.
3.What DTIA Bridge is
DTIA Bridge provides decision and documentation support based on your own answers, following the EDPB six-step methodology, and produces an audit-ready dossier for transfers to third countries. The tool processes metadata about your transfer, never the personal data you transfer.
4.No legal advice, no guarantee of compliance
DTIA Bridge gives no binding legal advice and guarantees no compliance or any particular outcome. A verdict is «defensible provided that», never a guarantee of compliance. You remain responsible for the assessment and for the decision to transfer data.
If you need individual certainty for a specific transfer, you can have the assessment reviewed or have bespoke work drawn up; that is a separate service of the provider. No liability can be derived from the use of the tool or of a generated dossier.
5.Account and use
- You create an account with correct and complete information and keep it up to date.
- You are responsible for keeping your login details confidential and for use via your account.
- The free version allows [ one active free dossier ]; the other features require a subscription.
- In the event of misuse we may suspend or terminate access.
6.Subscriptions, prices and payment
The subscription is charged per monitored transfer, per year. Prices are for business use and exclusive of VAT. Payment is made [ on invoice / via the payment provider ] within the period stated there.
A subscription runs [ term ] and is renewed [ renewal ], unless you cancel in time with due observance of [ notice period ]. The payment function and the exact terms apply once a paid subscription is offered.
7.Permitted use
- You use DTIA Bridge lawfully and not for unlawful purposes.
- You do not circumvent any security or access control and do not attempt to disrupt the service.
- You do not reproduce or distribute the curated legal content beyond your own accountability dossier, and you do not scrape the service.
8.Intellectual property
The tool, the software, the house style and the curated legal modules are the property of the provider or its licensors. You receive a limited, non-transferable right of use for the duration of your use. You may freely use the dossier you generate for your own accountability.
9.Data and privacy
How we handle personal data is set out in our privacy statement. We process metadata about the transfer, not the transferred personal data itself, and keep storage and processing within the EU/EEA.
10.Availability
We provide the service to the best of our ability. We may carry out maintenance or temporarily limit the service. We do not guarantee uninterrupted availability and may change the service or parts of it.
11.Liability
We are not liable for the legal outcome of an assessment or for decisions you make on the basis of the tool, nor for damage caused by incorrect or incomplete input or by indirect damage. Our liability is in any event limited to [ maximum amount / subscription amount ]. These limitations do not apply in the event of intent or deliberate recklessness on the part of the provider.
12.Changes to the service and the terms
We may amend the service and these terms. In the event of material changes we will inform you. If you continue to use the service after a change, you accept the amended terms.
13.Term and termination
You may cancel your account at any time. Upon termination we delete your account and your saved dossiers, as described in the privacy statement. We may terminate access in the event of misuse or breach of these terms.
14.Governing law and disputes
Dutch law applies to these terms and to the use of DTIA Bridge. We submit disputes to the competent court in [ district ].
